Those failures will not affect the advertising agreement, which is sold flat rate, and shall not result in a refund, or compensation of any kind.
All services rendered by New York City Extra are available first come first served, and at our discretion. We reserve and exercise the right to refuse services to companies or countries we feel are objectionable, non-compliant with our terms and/or guidelines, are in violation of our partner's terms, or have a history of problems, such as but not limited to FTC complaints, bad BBB records, bad publicity, linking to bad neighborhoods, or as defined and interpreted by us. This list of companies or countries we will not provide service to may and does change daily, and without notice.
New York City Extra lists businesses free or otherwise paid through monetary exchange in good faith that the business is conducted in compliance with our terms and acceptable business practices, but we make no guarantee that any business practices good and legal business services concerning their services and/or goods. It is up to the buyer to use good judgement and just prudence in selecting and maintaining trading partners. To that end, we give no advice as to whether a business is good to deal with, or not, and by listing them in our directories, we take no responsibility for their acts.
New York City Extra provides paid advertising options as part of the wide range of services offered, on an 'unlimited' basis. Unlimited is defined as any number of visitors from zero to infinite in any given billing periods, and as such the conditions of service are met once the ad(s) are place on the website and published to the web. It is expected that website with ads on our website will keep their website live, according to industry standards. Sites may be down during non-peak hours for maintenance. However, if a website is to be off line for more than a few hours, and the advertiser has banner ads on website, they must notify that the site will be down for an extended period of time. Any site down for 72 hours or more, will have their advertising suspended, whether we are notified in advance or not. Any website down for one week or more will be canceled, and will not be renewed. This is a sign of instability, and we will not refer out visitors to a website that can not be kept live on an ongoing basis. There are no refunds for partially used ad periods. See our ad cancellation policy below. The ads are provided on a subscription basis, and are billed in accordance with the subscription and payment method chosen, on a secure server. iHuggy sites have no access to credit card information. In order to cancel paid services the subscriber cancel their subscription -click hereto cancel the subscription and must notify us by email.
Should you disagree with the way your advertising account is handled, you may cancel at any time, and per our cancellation policy, you will receive no refund for the unused portion of your subscription period,since this is flat rate advertising. If you do so, and decide to attempt any compensation whatsoever, inspite of our no refund policy you agreed to, you agree to have the dispute resolved through a mutually agreed upon, third party, internet savvy, arbitrator, and that the arbitration take place through electronic communication only, with no physical appearance to take place. Any cost incurred for the arbitration process such as the cost of paying the arbitrator shall be limited to a maximum of $150, and shall initially be born by the complainant, and ultimately paid by the party found at fault. There shall be no compensation for damages, other than the actual cost of the advertising, with no damages awarded for loss of page views, loss of clicks, loss of sales, failure of business, emotional distress, initiative damages, compensatory damages, or any other costs outside the actual cost of advertising paid. This policy is to limit frivolous law suits, that would ultimately inflate our operating costs, and hurt all our advertisers as a whole.
New York City Extra reserves the right, and do exercise the right to modify listings to make them compliant to our terms, general publishing practices, or to increase the exposure of the ad and drive more traffic to the business linked to the listing. New York City Extra values the privacy of our subscribers, paid or free, and do not rent, lease, barter, trade, sell, or give away any information to any individual or company for any reason, with the exception of law enforcement agency's requests as part of a criminal investigation.
New York City Extra gathers information via sites stats, that comes in a generic form, without user name or exact physical location for the purpose of marketing research only. That information is displayed in generic form, as a method of site promotion, and may include the number of non-specific visitors to the site, how they arrived at the site, what keywords they may have used to find the site, how often they visit the site, where they go on the site, how long they stay on pages and on the site as a whole, and the day and time of the visit. Paid Ad Cancellation Policy: If you wish to cancel your ad, please keep in mind the ad will be pulled from our site the day you cancel it, as this is a flat rate service. To get the most for your advertising buck, you should cancel the day before your payment is due, or the last day of your advertising month.. As a flat rate advertising term, this is a non-refundable ad listing.
